I just got locked-up for simple assault. I have a prior for aggravated assault. Will the prior conviction effect me in the new case?
First, if you were to testify at the new case and state that you were "peaceful" its possible the old case could come into evidence to rebut your claim.
Second, if you are found guilty in the new case, the old conviction would definitely come into play at sentencing. It would either come through in regard to your prior record score, or simply for the fact that you had a prior assault type case.
